At the end of 12 months, participants who save the most energy will become eligible for a “Cool Rewards” bonus. If you’re one of the 100 top energy savers—among all the participants who enrolled in 2018-2019—you’ll be eligible to earn a bonus of $1,000, $500, or $250. Review the official rules below.

The first three months are your trial period. If you are consistently saving energy after three months, then you will become eligible to compete for a Cool Rewards Bonus. Each month after that, you’ll receive an update on your current rank among all the energy savers, and what level of Cool Rewards Bonus you are on pace to receive. You’ll also get tips for easy actions to take to save more energy. Note: Participation in the Cool Rewards Bonus is completely voluntary. If you don’t wish to compete with other program participants, you don’t have to do anything.

Official Rules — PG&E Cool Savers Cool Rewards Contest

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN, EXCEPT AS STATED IN THESE OFFICIAL RULES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. THE CONTEST IS VOID WHERE PROHIBITED BY APPLICABLE LAW OR BY REGULATORY ORDER BY THE CALIFORNIA PUBLIC SERVICE COMMISSION. ENTRANT MUST BE A PG&E CUSTOMER 18 YEARS OF AGE OR OLDER AT THE TIME OF ENTRY (See Rule #2 Eligibility). You are providing your information to Pacific Gas and Electric Company (“PG&E”) and to Build It Green (BIG), and you agree that the information you provide will only be used in accordance with PG&E’s privacy policies.     1. CONTEST SUMMARY: The Contest objective is to save the most energy after 12 months, compared to the other participants in the Cool Savers Program. A fund of $41,000 is available to 100 top energy savers who participate in Cool Savers between Sept. 2018 and Aug. 2019. Top savers will become eligible to earn a bonus incentive of $1,000, $500, or $250, depending on their energy-saving rank.
    2. CONTEST TIMING: The Cool Savers Cool Rewards Contest (the “Contest”) entry period begins on Friday, Sept. 14, 2018 at 12:01 a.m. Pacific Daylight Time (“PDT”) and ends on Friday, Aug. 30, 2019 at 11:59:59 p.m. PDT (the “Entry Period”). At the conclusion of the Entry Period, Contest winners will be announced on rolling, quarterly basis, beginning on or about Dec. 15, 2019 and ending on or about Sept. 15, 2020. Entry in the Contest does not constitute entry into any other promotion, contest or sweepstakes. By participating in the Contest, each entrant (“Entrant”) unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Pacific Gas and Electric Company, 77 Beale Street, San Francisco, CA 94105 (the “Sponsor”), and/or Build It Green, 300 Frank H. Ogawa Plaza, Suite 620, Oakland, CA 94612 (the “Administrator”) whose decisions shall be final and legally binding in all respects and not subject to further review in any forum.
        1. Contest entry date: For an individual Entrant, the Contest begins on the date in which their energy efficiency home improvements have been installed and completed, and runs for 12 months following that date.
      1. Quarterly Cohorts: Entrants will be grouped into one of four quarterly cohorts made up of other Entrants who enrolled in the Cool Savers Program during the same three-month period, as follows:
        1. Fall 2018 Cohort (September-November enrollment)
        2. Winter 2019 Cohort (December – February enrollment)
        3. Spring 2019 Cohort (March-May enrollment)
        4. Summer 2019 Cohort (June – August enrollment)

Prize Payment Schedule: Contest winners will be awarded a prize. According to the chart in section 3, Available Prizes.

3. ELIGIBILITY: This Contest is not open to the general public. The Contest is open only to PG&E customers who are legal residents of California, who enroll in the Cool Savers Program and reside in one of PG&E’s (49) service areas (“Service Areas”) where the Cool Savers Program is available: the counties of Alameda, Amador, Butte, Calavaras, Colusa, Contra Costa, El Dorado, Fresno, Glen, Kern, Kings, Madera, Mariposa, Merced, Nevada, Placer, Sacramento, San Joaquin, Shasta, Solano, Stanislaus, Tehama, Tulare, Tuolumne, Yolo, and Yuba. Entrants must be at least eighteen (18) years of age to participate in the Contest at the start of their Entry Period. By participating in this Contest, Entrants: (a) agree to be bound by these Official Rules and by the interpretations of these Official Rules by the Sponsor and the Administrator; (b) acknowledge compliance with these Official Rules; (c) represent and warrant that he or she meet all the eligibility criteria set forth in these Official Rules; and (d) agree to comply with any and all applicable federal, state and local laws, rules and regulations.

  1. Limit: One (1) entry per household during the Entry Period. The Sponsor, Administrator and its Contest vendors, the Electric and Gas Industries Association and Open Energy Efficiency, Inc., and each of their employees and their immediate family members and/or people living in the same household are not eligible to participate. All eligibility is subject to all federal, state and local laws and regulations. All entries submitted are the property of the Sponsor. This Contest shall be void where prohibited by law. Administrator’s database clock shall be the timekeeper for this Contest.
  2. Cool Savers Program Eligibility: Contest Entrants must first enroll in the Cool Savers Program. To qualify for Cool Savers, you must:
    1. Be a PG&E residential customer in one of the Service Areas listed above in section 3, Eligibility.
    2. Work with a selected participating contractor; a list of participating contractors can be found at www.coolhomesavers.com/contractor Install a minimum package of three improvements: 1) qualifying AC or AC/furnace package 2) qualifying smart thermostat and 3) duct sealing
    3. Provide virtual access to your home’s energy data
    4. Reside in a single-family, detached home that is at least 15 years old, and does not have rooftop solar PV or electric vehicle charging
    5. Have not participated in PG&E’s Home Upgrade rebate program within the past five years; PG&E’s AC Quality Care Program within 14 months of the start of the Entry Period; or PG&E’s Mobile Homes program, Energy Fitness Program or Home Energy Analytics’ Home Intel Program within the past 12 months of the start of the Entry Period.
  3. Trial Period: The first 90 days of participation in Cool Savers are the trial period (“Trial Period”) for Contest Entrants. During the Trial Period, the Entrants’ energy-saving performance will determine whether they can enter into the Contest. The Administrator Build It Green will determine if each Entrant is accepted into the Contest based on two criteria. During the three-month trial period, Entrants must:
    1. Save 10% of your energy compared to your usage (normalized for weather changes) for the same three months from the previous year.
      OR
    2. Have a pattern of energy consumption that demonstrates, based on a software analysis of your historic energy use, that you have the potential to reduce your overall energy use in the next 12 months. Results of the software analysis will be determined solely by the Administrator. Entrants who do not meet at least one of the above criteria after the Trial Period will be removed from the Contest and deemed ineligible to receive a prize.
    1. AVAILABLE PRIZES: If you are one of the top 25 ranked energy savers in your quarterly cohort, you will be rewarded with a prize/incentive, either $1,000, $500, or $250:
      1. Rank #1-3 will each receive $1,000
      2. Rank #4-10 will receive $500
      3. Rank #11-25 will receive $250

      In the event of a tie between Entrants with the same rank and amount of energy saved after 12 months, then both Entrants will be rewarded with the same prize/incentive for their rank, and the Entrant who is ranked #26 in the quarterly cohort will also receive the $250 prize. In the event of a tie, the total amount of the Contest prizes will exceed $41,000, by whatever amount is rewarded to the tied Entrant and/or the amount given to the #26 ranked Entrant. An IRS form 1099 will be issued in each Winner’s name as required by law. Winner may be required to provide his or her social security number, and W-9 tax payer request for identification.

      1. Prize Payment Schedule: In total, across the four quarterly groups, 100 energy savers will receive Contest prizes (each a “Prize”) totaling $41,000. Contest winners (“Prize Winner(s)”) will be awarded a prize according to the following schedule:

      2. Prize Notes: Prize will be awarded only if the Prize Winners fully comply with these Official Rules. Prize is provided on an “as is” basis, without any warranty of any kind. Prize is non-transferable. Prize Winner is responsible for any and all applicable federal, state, and local taxes, if any, and any other unspecified expenses associated with acceptance or use of the Prize. No substitution or transfer of Prize is permitted. Sponsor expressly reserves the right to delay the announcement of the Prize Winner for any reason Sponsor deems necessary. In addition, Sponsor reserves the right to select an alternate Prize Winner in the event that any potential Prize Winner fails to comply with these Official Rules.
      3. Winner Notification: Prize Winners will be notified on a quarterly basis beginning or about Dec. 15, 2019 and ending on or around Sept. 15, 2020. Prize Winners will be notified via email based on the information supplied during the registration process. A check will be mailed to Prize Winner by the Administrator, Build It Green. If a potential Prize Winner is unable to participate in or accept the Prize or any portion of the Prize for any reason, Sponsor will have no further obligation to the potential winner. If the Prize or the Prize notification is returned as undeliverable or any non-compliance with the Official Rules, it will result in forfeiture of the Prize and will be awarded to the next Entrant in a quarterly cohort with the highest amount of energy savings, such that the full $41,000 pool of available incentives is delivered to eligible Entrants.
    2. HOW TO ENTER: Individuals who enroll in the Cool Savers Program will automatically be entered into the Contest’s Trial Period.
      1. Opt-Out: Entrants who do not wish to participate in the Contest may opt out by emailing the Administrator Build It Green at coolsavers@builditgreen.org with “Contest Opt Out” in the subject line.
      2. Cancellation: Sponsor reserves the right to cancel or modify the Contest if fraud, misrepresentation, or technical failures impair the integrity of the Contest as determined by the Sponsor, in its sole discretion, and to award the incentives based on Entrants participating prior to the cancellation.
    3. CONTEST OBJECTIVE AND WINNERS: The Contest objective is to save the most energy after 12 months, compared to the other Entrants in your quarterly cohort. The contest is based on the total amount of energy saved (kilowatt hours and therms, measured in British Thermal Units, or BTUs) in your home after 12 months.
      1. Measuring and Tracking Energy Savings: Entrants’ home energy consumption will be measured and tracked using a software called OpenEEMeter (“The Software”). The Software accesses your PG&E account information remotely after you provide permission via the Share My Data functionality on the PGE.com website. Each month, each Entrant will receive a “Cool Savers Report” via email that will share the following information:
        1. The total amount of energy you consumed the previous month (in kilowatt hours and therms)
        2. How much energy you saved compared to your usage for the same month in the previous year (normalized for weather changes)
        3. Your total energy savings since your start date in the program
        4. Your rank among all the energy savers in your quarterly group (e.g., #1, #32, etc.)
        5. What level of Contest incentive you are on track to receive ($1,000, $500, etc.) based on your current rank and total energy savings; note that your rank can change over time as other Entrants save more or less energy than you.
        6. To ensure fair competition and a level playing field, energy savings will be pro-rated for participants in each quarterly cohort who enter after the first month, (e.g., enrolling on June 15 vs. August 15, 2018).
      2. Odds of Winning and Number of Entrants in Each Quarterly Cohort: When each quarterly cohort is formed, you will be informed about how many Entrants are in your cohort. The number of Entrants in each cohort will affect your odds of winning. Again, the Contest objective is to save the most energy after 12 months, compared to the other Entrants in your quarterly cohort.
      3. Steps to Increase Your Energy-Saving Rank and Odds of Winning: The installation of your new air conditioning or AC/furnace package, combined with a smart thermostat and duct sealing, is designed to reduce your home’s energy consumption. But there are many things you can do to further decrease your energy use—and increase your rank among the energy savers in your group, such as:
        1. Installing additional energy-saving measures, like attic insulation, energy-efficient windows, or LED light bulbs (talk to your contractor)
        2. Taking steps to reduce energy waste in your home, such as turning off lights or unused electronics, or adjusting your thermostat a few degrees

        Each month in your Cool Savers Report, you will receive energy-saving tips customized to your home and your energy use. If you wish, you can also schedule a FREE phone consultation with an Energy Advisor, who will analyze your energy data and determine the best ways to save.

    4. PUBLICITY RELEASE/ASSIGNMENT OF RIGHTS: Acceptance of a Prize constitutes permission for Sponsor to request the use of the Prize Winner’s name for purposes of advertising, promotional and other purposes in any and all media. Sponsor agree to obtain written permission from Entrants or Prize Winners in order to use their name, photograph, likeness, voice, biographical information, statements and complete address.
    5. DISQUALIFICATION: Sponsor reserves the right in their sole discretion to disqualify any individual who is found to have tampered with the entry process or the operation of the Contest, to be acting in violation of these Official Rules, or to be acting in an unsportsman-like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to disparage, annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
    6. LIMITATION OF LIABILITY AND INDEMNITY: Neither Sponsor, Administrator, nor any of their respective subcontractors or affiliated entities or shareholders, officers, directors, employees, agents, representatives, successor and assigns, (the “Released Parties”) shall be held responsible for, and Entrant hereby releases the Released Parties from any claims arising from or in any way relating to: (i) technical failures of any kind, including but not limited to the malfunctioning of any software or hardware; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error which may occur in the administration of the Contest or the processing of entries; (vi) any injury or damage to persons or property, including but not limited to Entrant’s computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Contest (vii) use of any prize and (viii) the evaluation process including the outcome of the Contest.By participating in the Contest, all Entrant’s and Prize Winners agree to indemnify, defend and hold harmless Released Parties from any and all damages, claims, and liability (including attorney’s fees and costs) arising out of or relating in any way to Entrants and Prize Winners participation in Contest and acceptance or use of any Prize and to release all rights to bring any claim, action or proceeding against Released Parties. This includes, but is not limited to, any and all claims, demands, and causes of action for personal injuries or death and/or damage to personal or real property, theft, loss or damage of any kind, or any other harm suffered directly or indirectly arising from or in connection with potential Prize Winner’s participation in and/or entry into the Contest or acceptance or use of any Prize or, including but not limited to, traveling to, preparing for and/or participating in any Contest Prize-related activity and for any claims based on publicity rights, defamation, invasion of privacy, and Prize delivery.
    7. DISQUALIFICATION/FORCE MAJEURE: In the event an insufficient number of Entrants participate in the Contest, and/or Sponsor is prevented from awarding the prize or continuing with the Contest as contemplated herein by any event beyond its control, including but not limited to, fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then Administrator shall have the right to modify, suspend, or terminate the Contest. If the Contest is terminated before the designated end date, Sponsor will (if possible) judge all eligible, non-suspect entries received as of the date of the event, giving rise to the termination. Inclusion in such judging shall be each Entrant’s sole and exclusive remedy under such circumstances. Only the type and quantity of prize described in these Official Rules will be awarded.
  1. DISPUTES: EXCEPT WHERE PROHIBITED BY LAW, ENTRANTS AND PRIZE WINNERS AGREE THAT: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS CONTEST OR ANY PRIZE AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY THE LAWS OF THE STATE OF CALIFORNIA WITHOUT REGARD TO ITS CONFLICT OF LAWS PRINCIPLES, AND ALL CLAIMS MUST BE RESOLVED IN THE COURTS OF CALIFORNIA EXCEPT AS OTHERWISE STATED IN THE OFFICIAL RULES; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS CONTEST, BUT IN NO EVENT ATTORNEYS’ FEES; AND (3) UNLESS OTHERWISE PROHIBITED, UNDER NO CIRCUMSTANCES WILL ENTRANTS AND PRIZE WINNERS BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANTS AND PRIZE WINNERS HEREBY WAIVE ALL RIGHTS TO CLAIM, INDIRECT, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES, OR THE RIGHTS AND OBLIGATIONS OF THE ENTRANTS AND PRIZE WINNERS AND SPONSOR IN CONNECTION WITH THE PROMOTION SHALL BE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF CALIFORNIA, WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES (WHETHER OF THE STATE OF CALIFORNIA OR ANY OTHER JURISDICTION), WHICH WOULD CAUSE THE APPLICATION OF THE LAWS OF ANY JURISDICTION OTHER THAN THE STATE OF CALIFORNIA. THE PARTIES CONSENT TO EXCLUSIVE PERSONAL JURISDICTION IN CALIFORNIA. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAW AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
  2. ARBITRATION PROVISION: By participating in this Contest, each Entrant and Prize Winner agree that any and all disputes the Entrant may have with, or claims Entrant and Prize Winners may have against, the Promotion Entities relating to, arising out of or connected in any way with (i) the Contest, (ii) the awarding or redemption of any prize, and/or (iii) the determination of the scope or applicability of this agreement to arbitrate, will be resolved individually and exclusively by final and binding arbitration administered by the National Arbitration Forum (the “Forum”) and conducted before a sole arbitrator pursuant to the Code of Procedure established by the Forum. The arbitration shall be held at a location in California or at such other location as may be agreed by Administrator. The arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable participant may have entered into in connection with the Contest. There shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only the participant’s and/or Administrator’s individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated. The arbitrator shall not have the power to award punitive damages against the participant or Administrator or Sponsor. If any part of this Arbitration Provision is deemed to be invalid or otherwise unenforceable or illegal, the balance of this Arbitration Provision shall remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein. Entrant and Prize Winners irrevocably waive all rights to a jury trial.
  3. WINNERS LIST: To obtain the name of each winner, send a self-addressed stamped envelope to: Build It Green, c/o Cool Savers Contest Winner Request, 300 Frank H. Ogawa Plaza, Suite 620, Oakland, CA 94612. All such requests must be received by December 31, 2020.
